Copyright Policy

  1. Copyright notice

1.2   Subject to the express provisions of this notice:

(a)   we, together with our licensors, own and control all the copyright and other intellectual property rights in our website and the material on our website; and

(b)   all the copyright and other intellectual property rights in our website and the material on our website are reserved.

2.1   You may:

(a)   view pages from our website in a web browser;

(b)   download pages from our website for caching in a web browser;

(c)    print pages from our website;

(d)   stream audio and video files from our website; and

(e)   use our website services by means of a web browser,

subject to the other provisions of this notice.

2.2   Except as expressly permitted by the other provisions of this notice, you must not download any material from our website or save any such material to your computer.

2.3   You may only use our website for your own personal purposes, and you must not use our website for any other purposes.

3.1   All the work belongs exclusively to owns EA Detailer Pte Ltd. However, there are exceptions to this general rule. Some exceptions are:

3.2   Work is created by an employee pursuant to the terms of his employment, EA Detailer Pte Ltd owns the copyright in the work.

3.3   Where an employee of a newspaper, magazine or periodical creates a literary, dramatic or artistic work pursuant to the terms of his employment and for the purpose of publication in a newspaper, magazine or periodical, the proprietor of the newspaper, magazine or periodical owns the copyright in respect of publication in or reproduction for the purpose of publication in any newspaper, magazine or periodical.

3.4   If a portrait/photograph/engraving is commissioned by EA Detailer Pte Ltd, EA Detailer Pte Ltd owns the copyright in the work. If the portrait/photograph/engraving is required for a particular purpose, this purpose must be communicated to EA Detailer Pte Ltd in writing. EA Detailer Pte Ltd is the copyright owner, and we have the right to stop others from doing any act comprised in the copyright, unless such act is done for the particular purpose for which the portrait/photograph/engraving is created.

3.5   For other types of commissioned works: Ownership belongs to the commissioned party, unless the EA Detailer Pte Ltd and commissioned party otherwise agree.

  1. Protection of copyright

4.1   There is no need to file for registration to get copyright protection. EA Detailer Pte Ltd automatically enjoys copyright protection as soon as he creates and expresses his original work in a tangible form, such as in a recording or writing. Originality simply means that there is a degree of independent effort in the creation of the work.

4.2   A copyright work created by a Singapore citizen or resident is protected in many countries overseas by virtue of international agreements. Generally, under these international agreements, the work of a Singapore citizen or resident would be protected in countries that signed the agreements as though the work was made there.

  1. Acceptable use

5.1   You must not:

(a)   use our website in any way or take any action that causes, or may cause, damage to the website or impairment of the performance, availability or accessibility of the website;

(b)   use our website in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

(c)    use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software; or

(d)   conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent.

6.1   If you learn of any unlawful material or activity on our website, or any material or activity that breaches this notice, please let us know.

  1. Enforcement of copyright

7.1   We take the protection of our copyright very seriously.

7.2   If we discover that you have used our copyright materials in contravention of the licence set out in this notice, we may bring legal proceedings against you, seeking monetary damages and/or an injunction to stop you using those materials. You could also be ordered to pay legal costs.

  1. The © symbol

8.1   The use of the symbol is simply a notice of a claim that copyright exists. It does not give the EA Detailer Pte Ltd any substantive right and is therefore not crucial for copyright protection.

8.2   If EA Detailer Pte Ltd do not use the symbol it does not mean that we waive our right of copyright or that we lose protection. It may, however, be relevant in infringement proceedings if the infringing party claims that he did not know that the material was protected under copyright law.

  1. Permissions

7.1   You may request permission to use the copyright materials on our website by writing to us by email or post, using the contact details published on the website.

  1. Governing Law and Jurisdiction

8.1   This Agreement shall be governed by, and construed in accordance with, the laws of Singapore.

8.2   Any dispute arising out of or in connection with this agreement shall be submitted for mediation at the Singapore Mediation Centre (“SMC”) in accordance with SMC’s Mediation Procedure in force for the time being. Either Party may submit a request to mediate to SMC upon which the other Party will be bound to participate in the mediation within 30 days. Unless otherwise agreed by the Parties, the mediator(s) will be appointed by SMC. The mediation will take place in Singapore in the English language, and the Parties agree to be bound by any settlement agreement reached.

8.3   In the event of a non-resolution of the dispute in accordance with this Clause 8.1, the dispute shall be referred to and finally resolved by litigation in the courts of Singapore. The Parties hereby submit to the non-exclusive jurisdiction of the courts of Singapore.
